In accordance with the Data Protection Act 2018, we have a duty to protect any information we hold on you. The personal information you provide will only be used for the purpose of Plan Preparation and will not be shared with any third party unless law or regulation compels such a disclosure.

It should also be noted that in accordance with Regulation 19 of the Planning (Local Development Plan) Regulations (Northern Ireland) 2015, the council must make a copy of any counter representation available for inspection. We are also required to submit the counter representations to the Department for Infrastructure (DfI) as they will be considered as part of the Independent Examination process. Please note that when you make a counter representation to the draft Plan Strategy of the Local Development Plan your personal information (with the exception of personal telephone numbers, signatures, email addresses or sensitive personal data) will be made publicly available on the Council’s website.

SOUNDNESS

Soundness involves testing the principles, content and preparation processes of the development plan against a list of key agreed criteria which relates to procedural, consistency, and coherence and effectiveness tests. Further detail on soundness is set out in the Department for Infrastructure’s (DFI) Development Plan Practice Note 06 Soundness.

As the main purpose of the Independent Examination is to determine whether the development plan document is ‘sound’, any person wishing to make a counter representation should do so on the basis of soundness.  

In accordance with DfI’s Development Plan Practice Note 09 Submission and Handling of Representations, it should also demonstrate how it meets the requirements of sustainability appraisal.

Representations that primarily or wholly relate to the draft Plan Strategy’s associated documents – the Equality (Section 75) Screening and Rural Needs Impact Assessment (RNIA), Habitats Regulations Assessment (HRA) and the Sustainability Appraisal incorporating the Strategic Environmental Assessment (SA/SEA) – can be accessed from the table below.

These have been provided for information purposes and it should be noted that a number of the representations on the draft Plan Strategy listed in the main table may also make reference to these supporting assessments.
