Privacy Notice: Electoral Candidates and Agents


INTRODUCTION

This Privacy Notice is designed to help you understand how and why Lisburn and Castlereagh City Council processes your personal data in relation to electoral candidates, agents, and subscribers processes.

This notice should be read in conjunction with Council’s Corporate Privacy Notice.


1. WHO ARE YOU?

Virginia McVea is the CEO and Electoral Registration Officer for Northern Ireland. The CEO is the Returning Officer (RO) for all elections in Northern Ireland. The RO is responsible for the administration of electoral law in Northern Ireland. The RO is supported by staff in the Electoral Office for Northern Ireland (EONI).

The RO has appointed the Council Chief Executive to be the Deputy Returning Officer (DRO) for the District Electoral Areas (DEAs) served by Lisburn and Castlereagh City Council. As such, they are authorised to exercise all statutory powers of the RO but must do so under the RO’s supervision and in accordance with her direction.

The RO and the DRO are “Data Controllers” as defined by Article 4(7) of the General Data Protection Regulation (GDPR). The RO and the DRO have appointed Victoria Taylor as Data Protection Officer (DPO). Her contact details are:

2. WHAT PERSONAL DATA OF MINE DO YOU COLLECT?

For candidates, Council collects basic information, such as:

• Name
• Address
• Qualification to stand for election
• Date of birth
• Signature
• Party affiliation
• Details of spending
• Contact information, such as telephone number and email address (optional)


For agents, Council collects basic information, such as:

• Name
• Home and office address
• Signature
• Party affiliation
• Contact information, such as telephone number and email address (optional).


For subscribers (electors who sign a candidate’s nomination paper), Council collects basic information, such as:

• Name
• Elector number
• Signature
• Party affiliation


3. WHAT IS THE PURPOSE OF COLLECTING MY PERSONAL DATA?

The DRO is legally obliged to collect this data as part of the processes for nominations of candidates and appointment of agents. The data is then used on statutory notices and on ballot papers.

In some cases, candidates can select to withhold their home address from statutory notices and ballot papers. A home address form is used in these cases.

Election spending returns are also required by law, and are shared with the Electoral Commission and are open to public inspection.

Where contact details are provided, these are only used by the DRO and their staff for communication with you about the election.
